DMCA Policy
How to submit copyright infringement notices and counter-notifications for content hosted on XD's Cloud.
1. Introduction and Policy Overview
XD's Cloud ("XD's Cloud", "we", "our", or "us") operates a cloud storage, file management, and Docker container hosting platform (the "Services"). We respect the intellectual property rights of others and expect users of the Services to do the same.
This Digital Millennium Copyright Act ("DMCA") Policy explains how copyright owners may submit notices of claimed infringement regarding content uploaded, stored, or made available by users through the Services, and how affected users may respond. We do not actively monitor user-uploaded content for infringement, but we respond expeditiously to valid notifications submitted in accordance with this Policy.
2. Designated Agent for Copyright Notices
Notifications of claimed copyright infringement relating to content on the Services must be sent to our Designated Agent:

Optional: Physical notices may also be mailed to: XD's Cloud, Attn: DMCA Designated Agent, [Street Address], [City], [State] [ZIP], [Country]. Email remains the fastest and preferred method; postal notices may take significantly longer to process.
All DMCA notices must be submitted in writing to one of the addresses above. We do not accept DMCA notices by phone, social media, or other informal channels.
3. Filing a DMCA Takedown Notice
To be effective, a notification of claimed infringement must be a written communication that includes substantially all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works
- Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it, such as the server, container, file path, directory, or URL where the material resides
- Contact information for the complaining party, including name, mailing address, telephone number, and email address
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in the notification is accurate and that the complaining party is authorized to act on behalf of the owner of the exclusive right allegedly infringed
Notices that do not substantially comply with these requirements may be rejected or disregarded. Submitting a knowingly false or bad-faith notice may expose you to liability; see Section 7 below.
4. Our Response to Valid Notices
Upon receipt of a valid DMCA notification, we will:
- Remove or disable access to the allegedly infringing material as expeditiously as reasonably possible
- Notify the affected user that their content has been removed or disabled and provide a copy of the notification, unless prohibited by law
- Give the affected user an opportunity to submit a counter-notification in accordance with Section 5
- Document the notice and our response for compliance and audit purposes
We are not responsible for reviewing the legal merits of a claim beyond confirming that a notice substantially complies with the requirements of Section 3. Removal of content in response to a notice does not constitute an admission of infringement by us or by the affected user.
5. Counter-Notification Procedure
If material you uploaded was removed or disabled as a result of a DMCA notice and you believe the removal was the result of mistake or misidentification, you may submit a counter-notification. A valid counter-notification must include:
- Your physical or electronic signature
- Identification of the material removed or disabled and the location where it appeared before removal
- A statement, made under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the courts in your location (or, if outside your jurisdiction, any competent jurisdiction in which we may be found) and that you will accept service of process from the party that filed the original notice
Counter-notifications must be sent to contact@xdpxi.dev with the subject line "DMCA Counter-Notification". Upon receipt of a valid counter-notification, we may forward it to the original complaining party. Unless that party notifies us that it has filed a legal action seeking a court order to restrain the user from engaging in infringing activity, we may restore the removed material within a reasonable period, typically 10 to 14 business days.
6. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. A user may be considered a repeat infringer if they have been the subject of multiple valid takedown notices. We reserve the right to suspend or terminate access to the Services, including deletion of hosted content and containers, after repeated or particularly serious instances of infringement, at our discretion.
7. Misrepresentation and False Claims
Submitting a notification or counter-notification that contains material misrepresentations may result in liability for damages, including costs and attorneys' fees, incurred by us or the affected user as a result of relying on the misrepresentation. We reserve the right to pursue appropriate remedies against parties who knowingly submit false or abusive claims, and to disregard notices that appear to be submitted in bad faith.
